Section 1

About TradingTests

TradingTests.co.uk is a peer-to-peer test date swap community for UK learner drivers. We facilitate connections between learners who hold their own personally-booked DVSA driving test dates and wish to exchange those dates with one another. We operate as a matching and notification platform only.

We are not affiliated with the Driver and Vehicle Standards Agency (DVSA) or any UK government body. We do not book, manage, change or cancel DVSA test appointments on behalf of any user. All changes to a DVSA booking must be made by the learner themselves through the official portal at gov.uk, in compliance with DVSA rules effective from May 2026.

This website is operated under licence by Brooklands LLC, 3500 S Dupont Highway, Dover, Delaware, US 19901. You can contact us at support@tradingtests.co.uk.

Section 2

Nature of the Service & Important Disclaimers

TradingTests provides access to a community swap pool. When you join, you are placed in a monitored pool of local learners who have expressed a preference to swap their test date. We alert you when a potential match appears. The decision to proceed with any swap, and the execution of that swap through the DVSA portal, is entirely yours.

No guarantee of a match: Joining TradingTests gives you access to the local swap pool. We cannot and do not guarantee that a suitable swap will be found before your test date, or at all. Your existing DVSA test booking remains entirely in your name and under your control throughout your membership. If no match is found, your original test date is unaffected.

We aim to maintain the service at all times but do not guarantee uninterrupted availability. Planned or unplanned maintenance, technical issues or events beyond our reasonable control may affect access to the platform from time to time.

Section 3

Changes to These Terms

TradingTests may update these Terms from time to time to reflect changes to our service, our business or applicable law. We will notify you of any material changes by email before they take effect. The updated Terms will be posted at this URL with a revised "last updated" date.

Your continued use of the service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you should stop using the service and may be entitled to a refund of any unused portion of your membership in accordance with Section 13.

Section 4

Eligibility

You must meet all of the following conditions to use TradingTests:

You must be at least 17 years old — the minimum age at which a UK provisional driving licence may be held
You must hold a valid UK provisional or full driving licence
You must have a genuine, personally-booked DVSA practical driving test in your own name
You must be resident in the United Kingdom
You must be acting on your own behalf, not on behalf of another person

By using our service you confirm that you meet all of the above conditions. If we discover that you do not, we reserve the right to suspend or terminate your account without refund.

TradingTests is intended for individual consumers only. It may not be used for commercial purposes, by driving schools, by ADI instructors seeking to manage multiple students' bookings, or by any party acting as an agent or intermediary.

Section 5

Accuracy of Information

The test centre cancellation statistics displayed on TradingTests — including monthly and annual cancellation figures — are estimates derived from official DVSA data and historical records. They are provided for illustrative purposes only. Actual cancellation rates will vary by centre, time of year and prevailing DVSA backlog conditions.

You are responsible for ensuring that the test details you register — including your test centre, date and time — are accurate and match your actual DVSA booking. Inaccurate information will impair the matching process and may result in missed opportunities. We are not liable for any loss arising from information you provide inaccurately.

Section 6

Permitted Use

You may use TradingTests only for lawful personal purposes as a genuine UK learner driver seeking to swap your own DVSA test date. You must not use our service to:

Buy, sell, broker or transfer test date slots for commercial gain or on behalf of others
Circumvent, undermine or violate any DVSA rule, policy or guideline governing the booking or management of driving tests
Register test details that are not your own, or act as an agent for another person's booking
Harass, deceive, mislead or cause harm to other users of the platform
Engage in any fraudulent, unlawful or abusive activity in connection with the service
Attempt to gain unauthorised access to any part of the platform, its servers or systems
Use automated tools, bots, scripts or crawlers to access, scrape or interact with the platform

We reserve the right to suspend or terminate your account immediately and without notice if you breach these restrictions. Where a breach involves suspected criminal conduct, we reserve the right to report the matter to the appropriate authorities.

Section 7

Acceptable Use

In addition to the restrictions in Section 6, you must not use TradingTests to upload, transmit or share any material that is unlawful, defamatory, harassing, abusive, fraudulent or in violation of any third party's rights. You must not reproduce, redistribute or commercially exploit any content from this platform without our express written consent.

We monitor use of the platform and reserve the right to remove content, restrict access or terminate accounts where we reasonably consider use to be harmful to our community or in breach of these Terms.

Section 8

Intellectual Property

All content on TradingTests — including the platform design, text, graphics, data, code, the TradingTests name and logo — is owned by or licensed to TradingTests and is protected by UK and international intellectual property laws. Nothing in these Terms grants you any rights in that content except the limited right to access and use the service for your personal use.

Section 9

Disclaimer of Warranty

TradingTests is provided "as is" and "as available." To the extent permitted by law, we exclude all implied warranties, representations and conditions, including any implied warranty of satisfactory quality, fitness for a particular purpose or non-infringement.

In particular, we do not warrant or guarantee:

That you will find a suitable swap match within any particular timeframe or at all
That the service will be available continuously or free from errors
That the cancellation statistics displayed are accurate for your specific centre at any given time

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015 in relation to digital services, which requires that our service is provided with reasonable care and skill. If we fail to do so, you may be entitled to a repeat performance or, if that is not possible, a price reduction.

Section 10

Limitation of Liability

Nothing in these Terms limits or excludes our liability for:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Any liability that cannot be excluded or limited by applicable UK law
Your statutory rights as a consumer under the Consumer Rights Act 2015

Subject to the above, and to the fullest extent permitted by law, TradingTests shall not be liable for any indirect, incidental, special or consequential losses arising from your use of — or inability to use — the service. This includes but is not limited to loss of a test date, additional driving lesson costs, loss of employment opportunity or any other consequential economic loss.

Our total aggregate liability to you for any claim arising from these Terms or your use of the service shall not exceed the total amount you have paid to TradingTests in the six months immediately preceding the event giving rise to the claim.

Section 11

Your Right to Cancel — Consumer Contracts Regulations 2013

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a contract for digital services within 14 calendar days of purchase (the "cooling-off period"), without giving a reason.

Important — waiver of cooling-off right: By completing your purchase and ticking the relevant box at checkout, you expressly request that we begin providing the service immediately. You acknowledge that by doing so, you lose your right to cancel once the service has begun. This is permitted under Regulation 36 of the Consumer Contracts Regulations 2013. If the service has not yet begun, you retain the full 14-day right to cancel and receive a full refund.

To exercise your right to cancel (where applicable), contact us at support@tradingtests.co.uk with your name, order reference and the date of purchase. We will confirm your cancellation by return email.

Section 12

Security

We take reasonable technical and organisational steps to protect the security of our platform and your personal data. However, no internet-based system is completely secure and we cannot guarantee that your data will never be subject to unauthorised access or disclosure.

Important: TradingTests will never contact you to ask for your DVSA login credentials, provisional licence number, booking reference number or password. If you receive any communication claiming to be from TradingTests requesting these details, do not respond and contact us immediately at support@tradingtests.co.uk.

Section 13

Pricing, Billing & Refund Policy

TradingTests charges a one-off fee of £22.50 per test centre for access to the local swap community. All prices are stated inclusive of VAT where applicable. This is a one-off charge — there are no subscriptions, recurring payments or hidden fees.

Cancellation before service starts

If you cancel within 14 days of purchase and before the service has been activated, you are entitled to a full refund. Email support@tradingtests.co.uk with your name and order reference. Refunds are processed within 14 days.

Refunds after service activation

Once you have expressly requested immediate service commencement and the swap pool matching has been activated, the cooling-off right is waived (see Section 11). Refund requests after activation are considered on a case-by-case basis. We are not obliged to refund where the service has been properly provided.

Test date changes

Updating your registered test date within TradingTests is available at no additional charge, subject to your remaining DVSA change allowance. Under DVSA rules effective from March 2026, learners are permitted a maximum of 2 changes to their booking.

Billing errors

If you believe you have been charged incorrectly, contact us at support@tradingtests.co.uk as promptly as possible with your order reference and we will investigate and resolve the issue promptly. Refunds for genuine billing errors will be processed within 14 days.

Payment disputes and chargebacks: We ask that you contact us directly at support@tradingtests.co.uk before raising a dispute with your bank or card provider. We will always work to resolve issues fairly and promptly. Your statutory rights to raise a payment dispute with your bank are not affected by these terms. However, where a chargeback is raised without prior contact with us and we consider it to be made in bad faith, we reserve the right to contest it with evidence of the service provided.

Section 14

Payment Processing

All payments are processed securely by Stripe, a PCI DSS-compliant payment processor. We accept Visa, Mastercard and American Express debit and credit cards. By completing a purchase, you authorise TradingTests to charge the payment method you provide for the amount stated at checkout.

We never see, receive or store your card details. All card data is handled exclusively by Stripe in accordance with their terms and privacy policy. If you have concerns about a payment or suspect fraudulent use of your card, contact your card provider directly and notify us at support@tradingtests.co.uk.

Section 15

Third-Party Sites and Services

Our platform contains links to third-party websites including the official DVSA booking portal at gov.uk. These links are provided for your convenience and do not constitute an endorsement. TradingTests is not responsible for the content, availability or privacy practices of any third-party site.

Payment processing is provided by Stripe Inc. and is subject to Stripe's own terms of service and privacy policy. By using our payment process you also agree to be bound by Stripe's terms.

Section 16

Indemnification

You agree to indemnify and hold harmless TradingTests and its officers, employees and agents against any claims, liabilities, costs and expenses (including reasonable legal fees) arising directly from your breach of these Terms or your unlawful use of the service.

This obligation does not apply where the claim arises from our own negligence, breach of contract or breach of your statutory consumer rights.

Section 17

Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. If you reside in Scotland or Northern Ireland, the courts of your country of residence will also have jurisdiction.

If you have a complaint or dispute, please contact us in the first instance at support@tradingtests.co.uk. We aim to acknowledge all complaints within 2 working days and to resolve them within 14 working days.

If we are unable to resolve a dispute through direct correspondence, you may refer it to an approved Alternative Dispute Resolution (ADR) provider. As a UK consumer, you may also contact the Citizens Advice consumer helpline on 0808 223 1133 or visit citizensadvice.org.uk.

Nothing in these Terms prevents you from bringing a claim in the courts of England and Wales (or Scotland or Northern Ireland as applicable).

Section 18

General Provisions

Entire agreement. These Terms, together with our Privacy and Cookies Policy, constitute the entire agreement between you and TradingTests in relation to your use of the service and supersede all prior representations, communications and agreements.

Consumer rights not affected. Nothing in these Terms is intended to, or shall, limit or exclude any rights you have as a consumer under applicable UK law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Your statutory rights are not affected.

Severability. If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, invalid or unenforceable, that provision will be deemed severed. The remaining provisions will continue in full force and effect.

No waiver. Failure or delay by TradingTests in enforcing any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign, transfer or sub-licence your rights or obligations under these Terms without our prior written consent. TradingTests may assign these Terms, or any rights or obligations under them, to a successor entity in connection with a corporate reorganisation, merger or sale of assets, subject to the assignee accepting the obligations set out herein.

Electronic communications. By registering with TradingTests, you consent to receive service-related communications electronically including swap match alerts, order confirmations and updates to these Terms.

Force majeure. TradingTests shall not be liable for any failure or delay in performance of the service resulting from circumstances beyond our reasonable control, including but not limited to acts of God, changes in law or regulation (including DVSA rule changes), technical failures of third-party infrastructure or government-imposed restrictions.
